Welcome to Loanhelpline.in. By accessing or using our website (https://loanhelpline.in), our AI Agents, WhatsApp Chatbots, Social Media Pages, mobile applications, or speaking with our support team (collectively referred to as “Services”), you agree to be bound by these Terms of Service (“Terms”).
These Terms constitute a legally binding agreement between you (“User”, “You”) and Loanhelpline.in (“Company”, “We”, “Us”).
1. Nature of Services
Loanhelpline.in is a financial aggregator and advisory platform.
- Facilitator Role: We act as a bridge connecting borrowers with our partner Banks, Non-Banking Financial Companies (NBFCs), and financial institutions (“Lending Partners”).
- Not a Lender: We are not a Bank or an NBFC. We do not provide loans directly, nor do we issue credit cards or insurance products. We do not make credit decisions; these are made solely by the Lending Partners.
2. Eligibility
To use our Services, you represent and warrant that:
- You are at least 18 years of age.
- You are a resident of India.
- You possess the legal authority to enter into a binding agreement.
- You have not been previously suspended or removed from our Services.
3. Loan Approval and Processing
- No Guarantee: Submission of a loan application via our Website, AI Agent, or WhatsApp does not guarantee loan sanction.
- Lender’s Discretion: The decision to sanction, reject, or disburse a loan, as well as the interest rates and tenure, is at the sole discretion of the Lending Partner.
- Processing Fees: While Loanhelpline.in does not charge you a fee for using the Services, Lending Partners may charge processing fees. We advise you to read the lender’s terms carefully before signing any agreement.
4. User Obligations & Conduct
- Accurate Information: You agree to provide true, accurate, current, and complete information (Name, PAN, Mobile, Income, etc.). Providing false documents or fake identities constitutes fraud.
- Account Security: You are responsible for maintaining the confidentiality of your OTPs/Login details. You agree to notify us immediately of any unauthorized use of your account.
- Prohibition of Automated Access: You agree not to use any robot, spider, scraper, or other automated means to access the Services for any purpose, including data mining or extracting content, without our express written permission.
5. KYC & Anti-Money Laundering (PMLA) Compliance
- Due Diligence: You agree to submit valid KYC documents (PAN Card, Aadhaar, etc.) as required by our Lending Partners.
- Compliance: You authorize us and our partners to undertake statutory due diligence measures in compliance with the Prevention of Money Laundering Act (PMLA). Any suspicious activity may be reported to the relevant legal authorities.
6. Consent to Contact (DND Override)
By registering your phone number and email on our Website or interacting with our AI Agents, you explicitly authorize Loanhelpline.in and our Lending Partners to:
- Contact you via SMS, Phone Call, WhatsApp, or Email regarding your application, updates, and other financial products.
- Override DND: This consent overrides your registration with the National Do Not Call Registry (DND/NDNC).
7. Intellectual Property Rights & Third-Party Trademarks
- Our Content: All original content, designs, software, text, and graphics created by Loanhelpline.in are our exclusive property. Unauthorized reproduction, distribution, or modification of this content is strictly prohibited and may result in legal action.
- Third-Party Trademarks: The logos, brand names, and trademarks of Banks, NBFCs, and financial institutions displayed on our Services belong to their respective owners. They are used strictly for representational and identification purposes only. Loanhelpline.in does not claim any ownership over these third-party trademarks, nor does their display imply an exclusive endorsement by those institutions.
8. AI Agent & Chatbot Disclaimer
- Automated Responses: You acknowledge that parts of our Services utilize Artificial Intelligence (AI) and automated chatbots (including WhatsApp bots) to provide instant responses.
- Information Purposes Only: Responses provided by our AI Agents are for general informational purposes only and do not constitute a final loan offer or financial advice.
- Verification: While we strive for accuracy, AI systems may occasionally provide incorrect or outdated information. You agree to verify all interest rates, eligibility criteria, and terms directly with our human support team or the official loan agreement provided by the Lending Partner.
- No Liability: The Company shall not be liable for any errors, omissions, or misunderstandings arising from your interaction with our AI Agents.
9. Social Media Usage & Community Guidelines
- Public Interaction: You understand that comments, posts, and interactions on our Social Media channels (Facebook, Instagram, LinkedIn, YouTube, X, etc.) are public. Do not share sensitive personal information (like PAN, Aadhaar, Bank Account details) in public comments.
- Moderation Rights: We reserve the right to remove any content or block users who post abusive, defamatory, spam, or promotional content on our pages without prior notice.
- No Liability for DMs: Loanhelpline.in will never ask for processing fees or OTPs via Social Media Direct Messages (DMs). Please verify the authenticity of the profile before interacting.
- Third-Party Terms: Your use of our social media pages is also subject to the Terms of Service of the respective platforms.
10. Disclaimer of Warranties (“As Is”)
- No Warranty: The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Loanhelpline.in does not warrant that the Website or AI Agents will run error-free, uninterrupted, or free of viruses.
- Technical Glitches: We are not liable for any data loss, service interruption, or damages caused by technical failures, internet issues, or events beyond our control (Force Majeure).
11. Limitation of Liability
To the fullest extent permitted by law:
- Loanhelpline.in shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services or inability to secure a loan.
- We are not responsible for any disputes regarding loan repayment, interest rates, or service quality that may arise between you and the Lending Partner.
12. Indemnification
You agree to indemnify, defend, and hold harmless Loanhelpline.in, its directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:
- Your breach of these Terms of Service.
- Your submission of false or misleading information/documents.
- Your violation of any law or the rights of a third party.
13. Dispute Resolution & Arbitration
- Amicable Resolution: In the event of any dispute, the parties shall first attempt to resolve it amicably.
- Arbitration: If unresolved, the dispute shall be referred to a Sole Arbitrator appointed by Loanhelpline.in. The arbitration proceedings shall be conducted in English.
- Jurisdiction: The seat of arbitration and exclusive jurisdiction for any court proceedings shall be New Delhi.
14. Electronic Communication
You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically (via email, WhatsApp, or website posts) satisfy any legal requirement that such communications be in writing.
15. Third-Party Links
Our Services may contain links to third-party websites (e.g., Bank portals). We are not responsible for the content, privacy policies, or practices of those external sites.
16. Updates to Terms
We reserve the right to modify these Terms of Service at any time. Continued use of the Services after changes implies your acceptance of the new Terms.
